Court of Appeal quashes case filed against HC Judge Gihan Pilapitiya
The Court of Appeal today (25) issued a writ order on the instructions of the Attorney General to the Nugegoda Magistrate quashing the case filed against High Court Judge Gihan Pilapitiya in connection with the controversial phone call matter involving former Parliamentarian Ranjan Ramanayake.
On January 23, 2020, on the instructions of Attorney General Dappula de Livera, the Colombo Crimes Division issued another writ order quashing the case.
Accordingly, a writ order was issued by the bench comprising Justices Sobitha Rajakaruna and Dhammika Ganepola, preventing law enforcement authorities from taking action against High Court Judge Gihan Pilapitiya over the incident.
The Attorney General had previously instructed the CCD to make submissions to the Nugegoda Magistrate’s Court and obtain a warrant to arrest High Court Judge Gihan Pilapitiya.
Accordingly, the CCD had reported to the Nugegoda Magistrate’s Court against the High Court Judge.
After considering the said information, the magistrate had issued notice on the High Court Judge to appear before the court.
Subsequently, the High Court Judge filed a writ petition seeking a court of order, claiming that the charge sheet had been filed against him in a malicious manner by concealing the facts and presenting a false report.
