Commercial HC Fiscal Officer interdicted


The Ministry of Justice, Prisons Affairs and Constitutional Reforms has taken steps to interdict the Fiscal Officer of the Colombo Commercial High Court, on charges of overriding his authority when enforcing the Enjoining Order issued by the Court for the detention of the Russian Aeroflot aircraft at the BIA.

Minister Wijeyadasa Rajapakshe also informed Chief Justice Jayantha Jayasuriya that action should be taken against the lawyer allegedly involved in the incident.

On 2 June, the Commercial High Court of the Western Province, issued an Enjoining Order on the Aeroflot aircraft, restraining it from taking off from the BIA. The flight which was scheduled to depart the BIA on 2 June to Moscow with 191 passengers and 13 crew members, was cancelled due to the enjoining order.

The Court hearing to lift the restriction on the aircraft was scheduled for 8 June. However, the AG had filed a motion seeking to make special submissions with regard to case, which was subsequently taken up for hearing on 6 Monday.

The Colombo Commercial High Court on 6 Monday issued an order for the immediate suspension of the enjoining order issued against the Russian Aeroflot aircraft, which had been detained at the Bandaranaike International Airport (BIA) following which the Aircraft returned to Moscow.
