Shoot on sight order illegal – Sumanthiran


The recent order issued by Defence Ministry Secretary General Kamal Guneratne, to shoot on sight those who continue to vandalise, loot, and damage public property, is illegal, spokesman for the TNA, MP M.A. Sumanthiran said.

He explained that as per Article 52.3 of the Constitution,when the Cabinet of Ministers ceases to function, the work of Ministry Secretaries also fall under the same category, thus, such individuals could not issue any edicts or orders.

Therefore, Sumanthiran argued that Guneratne’s directive is not legally binding and should be declared null and void by the Courts. The previous Cabinet currently stands dissolved in the wake of the resignation of former PM Mahinda Rajapaksa from office early this week.
