Colombo Chief Magistrate, Lanka Jayaratna today (10) announced in Court that Beneficiary Owner of the Primary Dealer Perpetual Treasuries Private Limited, Arjun Aloysius, could seek the help of lawyers before appearing at the CID on each Sunday.
However, she informed the Court that lawyers appearing for Aloysius will have no authority or power to either intervene or put pressure on the framework implemented by the CID towards obtaining the suspect’s signature and other such related procedures.
Chief Magistrate Jayaratna issued these orders after considering a Motion regarding an incident that had taken place at the CID on 6 January, when Aloysius had reported to it along with two of his lawyers to honour a bail condition imposed on him by Court.
One of the conditions imposed on Aloysius, when enlarging him on bail after being incarcerated for close to 11 months on charges of his involvement with the Central Bank of Sri Lanka Treasury Bonds scam, had been to report to the CID every Sunday.
Attorney-at-Law, Sajitha Jayawardene, filing a Motion in Court, said that his client had visited the CID on 6 January, along with two lawyers to fulfill a bail condition imposed on him by Court.
Attorney-at- Law Jayawardene told Chief Magistrate Jayaratna that the CID officers had objected to the presence of two lawyers and had prevented them from entering the CID, saying that Court had not given approval for the suspect to be present with lawyers.
He further informed Court that his client had gone to the CID with two lawyers as there was a possibility of bail being revoked on his client if he were to exert pressure on any witnesses in the case, and due to the limited knowledge his client has of the Sinhala language.
The CID, making submissions in Court, said they have already provided facilities to the suspects and services of translators had been sought to overcome any issues related to language.
Taking the submissions into consideration, Chief Magistrate Jayaratna said that any citizen in the country could seek the help of lawyers and that it has also been validated through an Order given by the Supreme Court.
